Small Business License for Copyrighted Artwork Collections

This license allows you to use any of cuddlecreek.com's original, copyrighted artwork for your home based small business within the terms of use and upon cuddlecreek.com's approval.

By purchasing this license you hereby agree to not produce more than 200 items per calendar year using any one image belonging to cuddlecreek.com.
You also agree within this agreement to not mass produce products using cuddlecreek.com artwork, sell products commercially within the terms of this agreement, or process products using professional machinery, nor upload, ship, or send products using cuddlecreek.com in whole or as part of any product  to manufacturers in the United States of America or abroad.

If your intent is to sell over 200 items per calendar year using any one image of cuddlecreek.com artwork, or have items professionally manufactured, do not purchase this license, rather contact us in regards to a Licensing Agreement for Copyrighted Artwork.

Small Business License Fees are set forth as a additional sum of 50.00 per year  for as long as you choose to produce and sell designs using cuddlecreek.com artwork as an enhancement to the designs you create under the terms of this agreement.
If you should decide not to renew your small business license, you are required to remove all products located within your business that have been designed using cuddlecreek.com artwork immediately, and you agree to destroy said artwork  for any financial gain, you may continue to use the artwork only as a personal craft and no items can be made available to the public for profit if you choose not to renew the small business license.

Should you sell over the alotted 200 items using any ONE image, per calendar year, it is your responsibilty to contact cuddlecreek.com to request a modified legal licensing agreement for copyrighted artwork.

Small Business License holders, are held to stricter terms of use than Licensing clients, if you feel you do not fall into the Small Business License category, please do not hesitate to contact us regarding Licensing.
It may be more prudent to contact us regarding licensing an image or artwork collection should your business produce close to the 200 item allocation.

As a small business license holder cuddlecreek.com would be happy to add a 468 x 60 banner ad to our banner rotation increasing your website traffic statistics.

You would be asked to join a private mailing list for small business license holders, this mailing list is seperate from our normal update newsletter and can afford you private sales or special coupon offers.

We would also be happy to have you submit to us photographs of your product creations as part of cuddlecreek.com's image folder - displaying your work in a category with a link back to your website.

You could also be invited to become a even more integral part of cuddlecreek.com  as a vendor or take part in commission sales as a job opportunity.

Cuddle Creek LLC also has an Affiliate program you may consider joining in order to make a small profit by providing either banner or text link back to us at your website, should a visitor click on a banner or text link at your website and purchase an item at cuddlecreek.com you would make a profit of the sale.
We do create private campaigns for individual categories you may be interested in.

In order to use cuddlecreek.com's copyrighted artwork, you must understand the terms of use.

When purchasing a download, you are not purchasing the artwork, the artwork is owned and copyrighted to cuddlecreek.com or Cuddle Creek LLC which is a registered LLC in the state of Arizona, USA and is legally trademarked.
You are legally bound by this agreement, any deviation from the agreement or violation of the terms will be vigorously prosecuted.

You may not portray your business as being part of Cuddle Creek LLC or its subsideries.
You are required to place our copyright notice on all products created, as well in the the product description of any item enhanced with cuddlecreek.com artwork.
You may not mix and match cuddlecreek.com artwork with that of other artists, artwork collections have been created with enough items to be able to design a complete product without the assistance of othe works.

In order to use the artwork you are required to create an actual design using the artwork as an enhancement.
You may not use the artwork in its pure form as items such as 3D Decopauge Sheets, Rubber Stamps, Cricut Cartridges, Cut-Outs, 3D Cards, Pop-Ups,  Cross Stitch, Latch Hooks or any item that is not a "design" .

Example -
Items made by you that are cuddlecreek.com artwork which are made to used by cutting or sewing around the image is not a design.

Artwork may not be compiled into any type of kit that your customers purchase to put together themselves.

If you refuse to follow these terms, after being approved, your license will be revoked and you will be required to remove any product located at your business with cuddlecreek.com artwork on it immediately.

Once you have applied and been accepted, as a small business license holder for cuddlecreek.com 's copyrighted artwork, you will be sent to purchase the rights to use the artwork.

How to Purchase -

As stated license are sold as a recurring payment, you may choose to have this payment set up as an automatic deduction from either a PayPal account, or Credit Card.

Purchase Now -

Prior to purchasing, you must first be approved, if you have been approved all licenses are set to automatic renewals per year, again should you choose to not renew, you will need to cancel the subscription via your paypal account and no longer use cuddlecreek.com copyrighted artwork for profit.

Set Up Automatic Payments -
To do this, rather than add the license to your cart, click on the Subscribe button,  you will then be directed to PayPal where you can choose to pay via your paypal account or a credit card.
